1. Subordination of Courts (Section 3)
- The Rule: Every civil court has a clear rank. The District Court is directly subordinate to the High Court.
- The Hierarchy: Every civil court of a grade lower than the District Court, as well as every Court of Small Causes, is subordinate to both:
- The High Court
- The District Court
2. Revenue Courts (Section 5)
- The Rule: Section 5 governs how the CPC applies to Revenue Courts (courts dealing with land revenue, rent, or agricultural profits).
- Application: The CPC does not automatically apply to them; the Provincial Government must issue a specific notification to apply it.
3. Pecuniary Jurisdiction (Section 6)
- The Rule: Section 6 explicitly dictates the Pecuniary jurisdiction (monetary limit) of civil courts.
- The Boundary: No court can hear or try a lawsuit if the total monetary value of the case exceeds the specific financial limit that the court is legally authorized to handle.
4. Small Cause Courts (Sections 7 & 8)
- Provincial Small Cause Courts (Section 7): Certain technical parts of the CPC do not apply to them to keep their processes quick and simplified.
- Presidency Small Cause Courts (Section 8): This section has been omitted (repealed) in Pakistan since the old British presidency administrative units no longer exist.
