Order 41 โ Appeals from Original Decrees
1. Form and Contents of an Appeal (Rules 1, 2, & 3)
- The Document: Every appeal must be preferred in the form of a Memorandum signed by the appellant or their pleader.
- Accompaniments: The memorandum of appeal must be accompanied by a copy of the Decree (and the judgment it is based on).
- Contents: The memorandum must contain Grounds of objections to the decree without any argument or narrative, numbered consecutively.
- Amendment (Rule 3): If the memorandum is defective, the court can reject it or return it for amendment under Rule 3 of Order XLI.
2. Admission, Endorsement, and Notice (Rules 9, 15, & 17)
- Registration (Rule 9): When a memorandum of appeal is admitted, the Appellate Court (or its proper officer) endorses the presentation date and registers it in the appeal book.
- Ex-Parte Notice (Rule 15): The notice issued to the respondent explicitly declares that if they fail to appear in the Appellate court on the fixed day, the appeal will be heard ex-parte.
3. Hearing, Security, and Stay of Execution (Rules 5 & 11)
- Stay of Execution: Filing an appeal shall Not operate as an automatic stay of execution of a decree.
- Court Demands: To grant a stay or proceed with the appeal, the appellate court may demand Security or Cost (Both A and B) from the appellant.
- Dismissal of Appeal: An appeal may be dismissed when the Appellant does not appear (default) or when the Court is not satisfied with its maintainability at the admission stage under Rule 11 (Both A and B).
4. Powers & Final Disposition of the Court (Rule 33 Context)
- Disposing of the Appeal: While deciding and disposing of an appeal, the Appellate Court passes a Judgment followed by an operational Decree (Both A and B).
- Powers over Trial Decree: The appellate court is fully empowered to Confirm, Modify, or Set aside the decree of the lower court (All of these).
- Pauper Appeals (Rule 22(5)): Under Order 41 Rule 22(5), the statutory provisions relating to a Pauper appeal (appeals by indigent persons) apply to cross-objections filed under this rule.
