Place of Suing (Sections 15โ20)
1. Institution in Lowest Court (Section 15)
- The Golden Rule: Every suit shall be instituted in the Court of the lowest grade competent to try it.
- The Incompetence Trap: If a court passing a decree completely lacks structural or financial jurisdiction over the matter, that decree carries no binding effect (it is a legal nullity).
- Application Boundary: This baseline rule of filing in the lowest court applies to the initial filing of suits (like partition, recovery, or transfer of immovable property), EXCEPT when filing an appeal against a decree, which must go to a higher/appellate court.
2. Suits Regarding Immovable Property (Section 16 & 17)
- Section 16 (Subject Matter Location): Suits must be filed where the property is physically situated for actions involving:
1. Partition of immovable property
2.Foreclosure, sale ,redemption of mortgaged property
- Section 17 (Property in Different Jurisdictions): Where immovable property is situated within the jurisdiction of different Courts, the plaintiff may institute the suit in any Court within whose local limits any portion of the property is situated.
3. Uncertain Territorial Jurisdiction (Section 18)
- Property Type: Section 18 applies strictly to cases of uncertain jurisdiction regarding immovable property.
- Procedural Prerequisite: For a court to entertain the suit when boundaries are vague, the recording of a statement to that effect by the trial court (stating its satisfaction regarding the uncertainty) is mandatory.
4. Compensation for Personal or Movable Wrongs (Section 19)
- Scope: Section 19 deals strictly with suits for compensation regarding movable property or a personal wrong (such as defamation/libel).
- The Dual Forum Choice:The plaintiff has a choice to sue either:
1. Where the wrong/tort/cause of action occurred, OR
2. Where the defandant resides or carries on business.
- Defamation Example: If Ahmed (residing in Islamabad) publishes defamation against Rehan in Lahore, the wrong is done in Lahore, and the defendant is in Islamabad. Rehan can sue at both A and B (either Islamabad or Lahore).
5. General Residual/Catch-All Provision (Section 20)
- Scope: Governs all other civil suits not specifically covered by sections 16โ19 (e.g., contract breaches, family disputes, general money claims).
- The Options: Suits may be instituted where the defendant resides, where he carries on business, or where the cause of action arises (wholly or in part).
- Mandatory Verbatim Clause: Section 20(c) states that a suit shall be instituted in a Court within the local limits of whose jurisdiction the cause of action, wholly or in part, arises.
