Questions to be Determined by Court Executing Decree โ Section 47 CPC
1. The Core Scope & Stage
- The Stage: Section 47 deals exclusively with questions arising during the Execution stage of a civil suit.
- The Three Core Elements: The executing court is empowered to determine all questions relating to the:
- 1. Execution
- 2. Discharge
- 3. Satisfaction of a decree.
2. The Parties Involved
- Who: The questions must arise Between the parties to the suit, or their legal representatives.
3. The Statutory Jurisdictional Bar
- The Rule: All execution questions shall be determined by The court executing the decree and NOT by a separate suit.
- The Effect: Section 47 acts as an absolute BAR on filing a fresh or separate civil suit. A separate suit cannot be instituted to settle execution disputes.
4. Conversion of Proceedings & Court Fees [Section 47(2)]
- The Power to Convert: The Court may, subject to any objection as to limitation or jurisdiction, treat an execution proceeding under this section as a suit, or a suit as an execution proceeding.
- The Condition: If the court converts the proceeding, it may order the payment of any additional court fees if necessary.
