Appeals Against Acquittal (Ss. 417โ418)
- Section 417: Appeal against an acquittal order can be made against orders passed by Magistrate Court or Court of Session (Both).
- Limitation: Appeal must be made within 30 days by an aggrieved person against an acquittal order passed by any Court other than the High Court.
- Section 417(5): An appeal against conviction and acquittal pertaining to offences under Ss. 354-A, 376, 377, and 377-B PPC shall be decided within six months.
- Complainant's appeal route: Complainant can appeal against an acquittal order by obtaining special leave under S. 417.
- Section 418: Appeal may be filed on matters of law and fact (Both).
