Appeals โ Forums for Conviction (Ss. 408โ410)
- Section 408: A person convicted by a Magistrate for an offence under S. 124-A PPC may appeal before the High Court; an appeal under S. 408 can be made against conviction by a Magistrate.
- S. 408 appeal forums: Available against conviction passed by Judicial Magistrate, Assistant Sessions Judge, or Special Magistrate (All of these); also applies to persons sentenced under Section 349, with appeal lying to the Court of Session.
- Assistant Sessions Judge sentence of 5 years: Appeal lies before the High Court.
- Assistant Sessions Judge appeal jurisdiction: May hear appeal against conviction passed by a Magistrate of second class or third class (Both).
- Section 409: An appeal may be heard by the Sessions Judge, Additional Sessions Judge, or Assistant Sessions Judge (All of these).
- Section 410: Any person convicted by a Sessions Court or Additional Session Judge (Both) may appeal; such appeal lies against an order of conviction, and as per S. 410, appeal from a Sessions Judge or Additional Sessions Judge lies to the High Court.
