Arrest by Police & Private Persons (Ss. 57โ61)
- Section 57: When a person accused of a non-cognizable offence does not provide true name and residence, he can be arrested.
- Section 58: A private person may arrest another private person only in case of a cognizable and non-bailable offence.
- Under Section 59, a private person may arrest a person who in his view commits a non-bailable and cognizable offence, or any proclaimed offender.
- If a private person arrests someone believed to be a proclaimed offender, he must, without unnecessary delay, hand over the arrested person to a Police Officer.
- Section 58 (pursuit): A police officer may pursue a person he is authorized to arrest into any place in Pakistan.
- Section 61: No police officer shall detain in custody a person arrested without warrant for a period longer than twenty-four hours.
- Section 62: In the absence of the Zila Nazim, the officer in charge of a police station shall report apprehensions to the DCO.
