Commencement of Proceedings Before Court (Ss. 204โ205)
Chapter XVII (Ss. 204โ205) covers the commencement of proceedings before court.
- Section 204: Court may issue summons or warrants (Both), depending on circumstances, for proceeding with a case.
- Process fees: If not paid within reasonable time, the Court may dismiss the complaint.
- Section 204(3): Where process/other fees are payable by law and not paid within a reasonable time, the Court may dismiss the complaint.
- Sufficient ground: Process is issued where there is sufficient ground for further proceeding.
- Purpose of summons: Issued by the trial court under S. 204 to face trial in connection with a complaint.
- Section 205: The Magistrate may dispense with the attendance of the accused.
