Complaint, Public Prosecutor & Other General Definitions
A few more procedural actors and concepts are defined early in the Code.
- Complaint [section 4(1)(h)] of the Cr.P.C, Complaint means the allegation made orally or in writing to a Magistrate, with a view to his taking action, under this Code that some person whether known or unknown, has committed an offence, but it does not include the report of a police officer.
- Public Prosecutor: A person conducting prosecution on behalf of the State.
- High Court [S. 4(j)]: Means the highest court of criminal appeal or revision for a province โ hence the High Court is deemed the highest court of criminal appeal and revision (Both) for a province.
- Offence under special laws: "Offence" under CrPC also includes any act punishable under Section 20 of the Cattle Trespass Act, 1871 in respect of which a complainant may be made.
- Such proceeding in course of which evidence may be legally taken on oath is called Judicial.
