Inquiry & Investigation
CrPC distinguishes between inquiry and investigation as separate procedural stages.
- Who may conduct an inquiry: An inquiry can be carried out by a Magistrate or Court (Both).
- Section 4(1)(k) : "Inquiry" includes every inquiry other than a trial conducted under this Code by a Magistrate or Court.
- Purpose of investigation: The sole purpose of investigation is to collect evidence (not to remove or reduce it).
- Who may investigate: Investigation can be conducted by a police officer or any person authorized by a Magistrate (Both).
- Section 4(1)(l): "Investigation" includes all proceedings under the Code for collection of evidence conducted by a police officer, or by any person (other than a Magistrate) authorized by a Magistrate in this behalf.
