Pre-Arrest Bail & Surety Provisions (Ss. 501โ502)
- Pre-arrest bail grounds: May be filed on grounds of malafide and ulterior motives on the part of the complainant and police (Both).
- Object of pre-arrest bail: To protect an innocent person from harassment and humiliation on the basis of a false implication (All of these, i.e., disrespect/humanitarian/harassment concerns collectively).
- Section 501: Court may issue a warrant of arrest of a person released on bail on account of insufficient sureties.
- Grounds for such warrant: Insufficient sureties arising through mistake, fraud, or any other way (All of these).
- Section 502(1): All or any sureties for the attendance/appearance of a person released on bail may apply at any time to a magistrate to discharge the bond, wholly or as it relates to the applicants.
