Security for Good Behaviour & Related Procedure (Ss. 109โ125)
- Section 109: Magistrate of first class may ask security for good behaviour from vagrants, suspected persons, and persons with no ostensible means of subsistence โ all of these.
- Section 112: Every summons/warrant shall be accompanied by a copy of the order made under this section.
- Section 113: If the person against whom an order under S. 112 is made is present in Court, it shall be read over to him, or its substance explained if he desires.
- Section 114: Magistrate may issue summons or a warrant (Both) for the absence of a person in court.
- Section 116: The Magistrate may dispense with personal attendance, permitting the person to appear by a pleader.
- Mode of imprisonment for failure to give security is simple.
- Section 124-A related appeals: A person convicted on trial by an Assistant Sessions Judge or a District Magistrate, sentenced to less than 4 years (or not convicted under S. 124-A PPC), may appeal before the Court of Sessions.
- Section 125: The Sessions Judge is empowered to cancel any bond for keeping the peace or good behaviour.
