Common Intention & Common Object
- s.34 โ Common intention: When a criminal act is done by several persons in furtherance of the common intention of all, each is liable in the same manner as if the act were done by him alone.Unanimous decision in a meeting to do a particular act is associated with Common intention.
- Common intention implies pre-arranged planning (a pre-meditated concert), not merely similar intention.
- To establish s.34, Common intention be proved but not over act be proved.
- s.38: Several persons engaged in a criminal act may be guilty of different offences (their individual liability can differ even though they acted together).
