Criminal Breach of Trust & Cheating
- s.405: Defines criminal breach of trust.
- Essential element: Transfer of possession (entrustment of property or dominion over it) โ not merely a contractual relationship.
- Punishment (s.406): Imprisonment up to 7 years, or fine, or both โ this applies to breach of "trust" generally (separate enhanced provisions exist for breach by agent/banker/public servant, but s.406 itself covers ordinary "trust").
- s.413: Habitually receiving or dealing in stolen property โ punishable with life imprisonment or imprisonment up to 10 years, and/or fine.
- Cheating by personation: Cheating by pretending to be another person, or knowingly substituting one person for another, or falsely representing identity.
