Diyat, Arsh & Compounding of Qisas
- Qatl-e-amd may be compounded by the legal heirs of the victim (Wali).
- Wali: The person entitled to claim Qisas โ normally the legal heirs of the victim; if none exist, the Government acts as Wali.
- Qisas for qatl-e-amd is not enforced where the offender dies before enforcement, or is the husband of the victim, or is insane, or a minor.
- Qisas cannot be waived where the Wali is the Government, a minor, or insane.If an additional finger of victim is cut so that will not be liable to Qisas.
- Diyat may be paid in lump sum or installments (within a period, generally 5 years).
- Minimum value of Diyat: Based on the present value of 30,630 grams of silver.
- Silver value notification: The Federal Government declares the value of silver by notification in the official Gazette on 1st July each year.
- Badal-e-sulah: Its value must not be less than the value of Diyat.
- An adult, sane Wali may compound the right of Qisas by accepting badl-i-sulah at any time.
- Arsh is the compensation which will be paid to legal heirs of the victim/victim.Payment of Arsh is described under section 337-X of PPC.
- The value of Daman may be determined by the court keeping in viewExpenses incurred on treatment by victim,Loss or disability caused in functionary of any organ or The compensation for anguish suffered by the victim.
- The Arsh for causing itlaf of a tooth shall be 1/20th of Diyat, Arsh of causing itlaf of finger of hand or foot shall be 1/10th of Diyat.Arsh for organs which are in pairs, if itlaf of such one organ is done, Arsh shall be half of diyat.
- Whenever a convict dies before a payment of Diyat, it shall be recovered from his Estate.
