Kidnapping & Abduction
- s.359: There are 2 kinds of kidnapping โ from Pakistan, and from lawful guardianship.
- s.360: Defines kidnapping from Pakistan.
- Kidnapping from lawful guardianship: Taking/enticing a minor (male under 14, female under 16) or a person of unsound mind, away from lawful guardian, without consent.
- s.362 โ Abduction: Compelling by force, or inducing by deceitful means, a person to go from any place.
- Punishment for kidnapping from lawful guardianship: Imprisonment up to 7 years, and fine.
- s.364: Kidnapping/abduction in order that the person may be murdered or placed in danger of murder โ imprisonment for life or up to 10 years, plus fine.
- s.365: Kidnapping/abduction with intent to secretly and wrongfully confine a person โ imprisonment up to 7 years, plus fine.
- s.365-A: Kidnapping/abduction for extorting property or valuable security โ punishable with death or life imprisonment.
- s.365-B: Deals with abducting a woman to compel marriage or for an illicit relationship.
- Lawful guardian: A person lawfully entrusted with the care or custody of a minor (or another) by a Court.
