Qatl-e-Amd & Qatl-i-Khata
- s.302(c): Whoever commits qatl-e-amd where, per the injunctions of Islam, qisas is not applicable, shall be punished with imprisonment which may extend to 25 years.
- s.300: Correctly defines qatl-e-amd as requiring (i) intention to cause bodily injury sufficient in the ordinary course of nature to cause death, (ii) knowledge that the act is likely to cause death, and (iii) that the very injury intended is the injury actually inflicted โ all elements together describe s.300.
- Illustration (deer/bystander): Aiming at a deer, missing, and killing a bystander = Qatl-i-khata (death by mistake).
- Punishment of qatl-i-khata: Payment of Diyat.
- Multiple offenders: If two persons agree to administer poison severally/at different times, and death results from the combined doses, both are liable for the death.
- Attempt to commit suicide: Punishable with imprisonment up to 1 year, or fine, or both.
- Thug: A person habitually associated with others for committing robbery or child-stealing by means of, or accompanied with, Qatl.
