Robbery & Dacoity
- In robbery, there is either theft or extortion โ plus an aggravating element.
- s.390: Theft becomes robbery when, in committing theft (or attempting/carrying away), the offender causes or attempts to cause instant death, instant hurt, or instant wrongful restraint.
- Robbery becomes dacoity when committed by five or more persons.
- Murder during dacoity: If, while five or more persons are jointly committing dacoity, one of them commits murder, every one of them is punishable with death or life imprisonment.
- s.393: Attempt to commit robbery โ rigorous imprisonment up to 7 years, plus fine.
- s.399: Preparation for committing dacoity โ rigorous imprisonment up to 10 years, plus fine.
- s.402-A โ Hijacking: Unlawfully seizing or exercising control of aircraft by force or threat.
- Punishment for robbery: Rigorous imprisonment not less than 5 and not more than 10 years, plus fine.
