Question of Law vs Question of Fact
- Question of law: As per Salmond, the term 'question of law' is used in three distinct but related senses, and is a matter for the judge.
- Question of fact: Means a question other than a question of law; it is a matter for the jury.
- Courts deal with: question of law, question of fact, and a mixed factor of question of law and fact โ i.e., all of these.
- Codification is the systematic collection of statutes โ a code means a systematic collection of statutes/body of laws so arranged as a collection.Codification is a process of transformation of corpus juris into Enacted law.
- Common Law, per Salmond, more usually means not the whole law of England but the residue of it after deducting any particular part with a special title of its own โ contrasted with equity, special law, and statute law (NOT contrasted with 'injustice').
