Chapter XII: Conduct with Regard to Other Advocates (Rules 134โ144)

- Scope: Outlines 4 kinds of duties; Rules 134 to 144 focus specifically on conduct with regard to other Advocates.
Core Rules
- Rule 134 (Professional Dignity): It is the duty of every Advocate to uphold the dignity and high standing of the profession, as well as both of these (the profession's dignity and his own dignity as a member).
- Rule 135 (Solicitation): An advocate shall not solicit professional employment by advertisement or any other means.
- Rule 136 (Fee Sharing): An advocate shall not share professional fees or compensation with an unlicensed person.
- Rule 137 (Opposing Party): An advocate shall not communicate about a subject of controversy with a party represented by another lawyer without consent.
- Rule 138 (Judge Communication): An advocate shall not communicate or argue before a judge in the absence of opposing counsel; arguments must be in open court.
- Rule 139 (Colleague Association): An advocate should decline association as a colleague unless the dues of the first retained advocate are paid. A client's proffer of assistance of an additional advocate is not evidence of a want of confidence.
- Rule 140 (Trial Decency): It is indecent to allude to the personal history or personal particularities of the opposing advocate.
- Rule 141 (Division of Fees): Division of fees is proper only with another advocate and must be based on the principle of division of work.
- Rule 142 (Order of Precedence): Advocates must maintain the order of precedence on the roll, subject to the constitutional usage established for the Attorney-General and the Advocate-General.
- Rule 143 (Senior & Junior Relations): Juniors must be respectful; seniors must be courteous and helpful.
- Rule 144 (Leading the Case): Where more than one advocate is engaged on any side, it is the right of the most senior member to lead the case, unless the senior wants otherwise
